Terms of Use

1. About These Terms: These Terms of Use ("Terms") are a legal agreement between you and Jawa Technologies Pty Ltd ABN 20 137 869 615 ("we," "us," or "our"). By using our services, you agree to these Terms. If you don't agree, please don't use our services. These Terms comply with Australian Consumer Law and telecommunications regulations.

2. Our Services: We provide optical fibre cabling services and related technical and project management support. Our Service may be interrupted by scheduled maintenance, technical faults or equipment failures, power outages, events beyond our control, or upstream network or systems issues.

3. Your Agreement: You must be at least 18 years old to enter this agreement. You agree to provide accurate contact and billing details, keep your information up to date, and take responsibility for all activity on your account.

4. Installation and Equipment: We'll agree terms of work arrangements under a separate legal agreement. That agreement will set out standards of performance, warranties as to performance and expectations as to key site and project particulars.

5. Your Responsibilities: You must not use our service to break any Australian laws, send spam or malicious software, hack, attack, or interfere with other networks or systems, infringe copyright or intellectual property, host illegal content, resell our service without permission. You must comply with Australian telecommunications and internet laws.

6. Service Faults and Support: Contact us as soon as possible if you experience service issues. We'll work to resolve faults during business hours, with emergency support available for major outages. If the fault is caused by your equipment, wiring, or premises, we may charge fees, as set out in our agreement, or as otherwise determined by us, acting reasonably.

7. Limitations and Disclaimers: Nothing in these Terms excludes your rights under Australian Consumer Law. To the extent permitted by law, we're not liable for indirect or consequential loss, our total liability is limited to the fees you've paid in the past 12 months, we're not responsible for third-party content or services, and we don't guarantee results. You acknowledge that the internet has inherent security risks, data transmission may be intercepted, content from others may be offensive or harmful. We exclude liability for such loss or damage.

8. Dispute Resolution: If you have a complaint, contact us first by email or phone to discuss the issue. If unsatisfied, ask for a manager to escalate internally.

9. Privacy: Your privacy is important to us. See our Privacy Policy for how we handle your personal information.

10. General Terms: We may update these Terms with 10 days' notice. Continued use means you accept the changes. We'll show the effective date of updated terms at the top of this page. You must notify us of any changes to your contact details. These Terms are governed by the laws of New South Wales. If any part of these Terms is invalid, the rest remains in effect. If we don't enforce a right immediately, it doesn't mean we've waived that right.
